General Terms and Conditions of Sale

अंतिम अपडेट 22 अक्टूबर 2026 · संस्करण 1.0

1. Nature of the service

Visaska is a private assistance service for applying for visas and electronic travel authorisations, operated by Kondoria — EURL, a commercial company governed by French law. Visaska is not a government department, an embassy or a consulate, and is neither approved nor appointed by any government.

Visaska helps you prepare your application and submits it on your behalf on the official portal of the competent authority. Visaska does not issue any visa or travel authorisation. The decision to grant or refuse an application rests exclusively with the authorities of the country concerned, and entry into the territory remains subject to the discretion of the border control authorities.

You may always submit your application yourself, directly to the authorities, paying only the official fees. The link to the official portal is shown on each destination page of the Site. By ordering from Visaska, you choose to pay a service fee in return for the assistance described below.

2. Purpose and scope

2.1 Purpose

These general terms and conditions of sale (the "GTCS") govern the contractual relationship between Kondoria — EURL, a EURL (entreprise unipersonnelle à responsabilité limitée) with a share capital of 1 000 €, whose registered office is located at 60 rue François Ier, 75008 Paris, France, registered with the RCS Paris 931 960 280 under number 931 960 280, intra-EU VAT number FR91931960280, operating the Visaska service available at https://visaska.com ("Visaska", "we"), and any person who places an order for a Service on the Site (the "Customer", "you").

2.2 Acceptance

Any order requires prior and unreserved acceptance of these GTCS, signified by ticking a checkbox at the time of the order. The applicable GTCS are those in force on the date of the order. They are sent to you on a durable medium together with the order confirmation.

Use of the Site is also governed by the General Terms of Use (the "Terms of Use"). The processing of your personal data is described in the Privacy Policy. In the event of any conflict, these GTCS prevail over the Terms of Use in all matters relating to orders.

2.3 Consumer and business Customers

The Services are primarily intended for consumers, within the meaning of the preliminary article of the French Consumer Code. Provisions reserved for consumers (in particular the right of withdrawal and consumer mediation) do not apply to Customers acting for business purposes, except where the law extends them to non-professionals or small businesses.

2.4 Capacity

To place an order, you must be of legal age and have legal capacity. An application for a minor must be made by one of the minor's parents or by the minor's legal representative (see Article 6.4).

3. Definitions

In these GTCS, the following terms have the meanings given below:

  • Authority: the government department, embassy, consulate or any public body competent to examine the application and issue the visa or travel authorisation.
  • Official Portal: the Authority's website or application through which the application can be submitted.
  • Application: the application for a visa, an electronic travel authorisation or an official entry form, prepared for a given Traveller and a given destination.
  • Traveller: the person for whom the Application is prepared. The Traveller may be the Customer himself or herself or a person on whose behalf the Customer is authorised to act.
  • Service: the assistance service ordered by the Customer, under the chosen Plan, for a Traveller.
  • Plan: the level of service chosen (Standard, Rush, Super Rush) or the single plan applicable to Free Official Forms.
  • Free Official Form: an entry form that the Authority makes available to travellers free of charge (for example the Thailand Digital Arrival Card (TDAC), the Malaysia Digital Arrival Card (MDAC), the Maldives IMUGA declaration or the Sri Lanka ETA for passports eligible for the free scheme).
  • Service Fee: the remuneration of Visaska for the Service, per Traveller.
  • Government Fee: the sums required by the Authority for the examination of the Application, including, where applicable, the surcharge for an expedited processing option offered by the Authority and the payment charges levied by the Official Portal.
  • Questionnaire: all the questions required by the Official Portal and the supporting documents (passport scan, photograph, supporting evidence) necessary for Submission.
  • Completed Questionnaire: the Questionnaire for which all questions have been answered and all documents have been provided and found to comply with the Authority's requirements during the check carried out by Visaska.
  • Submission: the submission of the Application on the Official Portal, evidenced by the reference number, acknowledgement of receipt or proof of payment issued by the Official Portal.
  • Submission Deadline: the period within which Visaska undertakes to make the Submission, depending on the Plan.
  • Delivery: the transmission to the Customer, by email and in the Customer's Tracking Area, of the visa or authorisation issued by the Authority or, where applicable, of the refusal decision.
  • Promised Delivery Date: the date displayed before payment and repeated in the order confirmation, by which, at the latest, Visaska undertakes to make the Delivery, subject to the Exclusions.
  • Exclusions: the events defined in Article 9.4, which suspend or postpone the Promised Delivery Date.
  • Tracking Area: the secure page, accessible with or without an account, on which the Customer tracks the Application, completes the Questionnaire, communicates with Visaska and receives documents.

4. Description of the Services

4.1 Content of the Service

For each Traveller, the Service comprises:

  1. checking the Traveller's eligibility for the visa or authorisation applied for, on the basis of the information the Traveller provides;
  2. assistance in completing the Questionnaire, in your language, with explanations of each question;
  3. checking the apparent compliance of documents (format, legibility, dimensions and framing of the photograph, validity of the passport in the light of the published rules), it being specified that Visaska does not verify and cannot guarantee the authenticity of documents;
  4. entering the Application on the Official Portal, on the basis of the information you have provided, and paying the Government Fee in your name and on your behalf;
  5. Submission within the Submission Deadline of the chosen Plan;
  6. tracking the Application until the Authority's decision and Delivery;
  7. customer service assistance throughout the Application.

The Service does not include: the issue of the visa, obtaining a favourable outcome, representation before the Authority in an appeal, embassy procedures requiring the physical presence of the Traveller (interview, fingerprinting), certified translation of documents, or legal advice on immigration law.

4.2 Plans

Plan Submission Deadline after Completed Questionnaire Specific content Service Fee per Traveller
Standard 24 h Submission and tracking; Delivery no later than the Promised Delivery Date 49 €
Rush 4 h Priority processing queue; proactive follow-up of the Application with the Official Portal and information to the Customer at each stage 79 €
Super Rush 1 h Dedicated agent reachable throughout the Application; use of the Authority's expedited processing option where available 129 €
Free Official Form Timeframe displayed before payment Single plan: entry and submission of the official form, transmission of the confirmation document 9 €

Submission Deadlines are calculated in continuous calendar hours, unless otherwise stated before payment. They run from the moment the Questionnaire is completed.

4.3 Expedited processing option (Super Rush)

Where the Authority offers an expedited processing option, the Super Rush Plan includes its use. The surcharge charged by the Authority for this option is a Government Fee: it is displayed separately before payment and re-invoiced to the exact cent, without any mark-up. Where the Authority does not offer an expedited option, this is indicated before payment and the Promised Delivery Date takes it into account.

4.4 Free Official Forms

Certain entry forms are free of charge and may be completed by you on the Authority's official website, the link to which is shown on the relevant page. If you choose Visaska, you pay only a Service Fee of 9 € per Traveller for assistance with and submission of the form; no Government Fee is charged.

4.5 Information on destinations

The information published on the Site (entry rules, required documents, official amounts and timeframes) is based on official sources and updated regularly. However, the rules laid down by the Authorities may change without notice. It is your responsibility to check that you meet all the conditions of entry and stay (passport validity, blank pages, vaccinations, insurance, return ticket, transit visas, etc.), which are not limited to the visa or authorisation that is the subject of the Service.

5. Mandate

By placing an order, you grant Kondoria — EURL a mandate (mandat), within the meaning of Articles 1984 et seq. of the French Civil Code, to perform the following acts in your name and on your behalf (or in the name and on behalf of the Traveller on whose behalf you are authorised to act):

  • create, where applicable, a file or an account on the Official Portal in the Traveller's name;
  • enter the information and upload the documents you have provided, without altering their substance;
  • validate the declarations required by the Official Portal, on the basis of the answers you have given and whose accuracy you certify;
  • pay the Government Fee to the Authority;
  • receive the Authority's communications relating to the Application and forward them to you.

The Traveller remains the applicant before the Authority. Visaska acts exclusively on your instructions and within the limits of this mandate, which ends upon Delivery, cancellation of the order or closure of the Application.

6. Ordering

6.1 Order steps

Orders are placed online, without the need to create an account, according to the following steps:

  1. choice of destination and of the country that issued the passport;
  2. indication of the number of Travellers and the travel dates;
  3. answers to the first questions of the Questionnaire;
  4. choice of Plan;
  5. display of a summary showing, for each Traveller, the Service Fee, the Government Fee, the total price, the currency, the conversion rate applied where applicable, and the Promised Delivery Date;
  6. entry of your email address;
  7. acceptance of the GTCS and express request for immediate performance (Article 13.3) by means of separate checkboxes;
  8. payment by means of a button labelled "Order with obligation to pay" or an equivalent unambiguous wording.

Before confirming, you may check the details of your order and correct any input errors.

6.2 Conclusion of the contract and confirmation

The contract is concluded at the time the payment is confirmed. Visaska sends you without delay, by email, an order confirmation setting out its essential characteristics, the price, the Promised Delivery Date, your request for immediate performance and your acknowledgement of the loss of the right of withdrawal upon full performance, these GTCS and the withdrawal form set out in the annex.

6.3 Remaining questions after payment

Certain questions and documents required by the Official Portal are requested after payment. Submission can take place only once the Questionnaire has been completed. You will be invited to complete it in your Tracking Area; reminders are sent to you for as long as it remains incomplete.

6.4 Orders for a third party or for a minor

You may order for several Travellers. When you order for a person other than yourself, you declare that you are authorised to act on that person's behalf (as a parent or legal representative of a minor, or by virtue of the express agreement of the adult concerned), that you have obtained the information relating to that person lawfully, and that you have informed that person of the processing of his or her data in accordance with the Privacy Policy. Visaska may ask you for any evidence of this authorisation and may suspend the Application if it is not provided.

6.5 Refusal of orders

Visaska may refuse or cancel an order, with a full refund, in the event of legitimate suspicion of fraud, manifestly false information, an Application falling outside the scope of the Services offered, a previous unresolved dispute with the Customer or the impossibility of submitting the Application (for example, an ineligible nationality).

7. Prices and Government Fees

7.1 Prices

Prices are stated inclusive of all taxes, in the currency you have chosen on the Site. Service Fees are payable per Traveller. The total price displayed in the summary before payment is the final price; no additional charge will be claimed from you by Visaska, subject to Article 7.5.

7.2 Government Fees: disbursements

Government Fees are always displayed separately from Service Fees. They are paid by Visaska to the Authority in your name and on your behalf, in performance of the mandate provided for in Article 5. They constitute disbursements (débours): they are re-invoiced for their exact amount, without any mark-up, are recorded in a third-party account and are excluded from the VAT taxable base of Visaska, in accordance with Article 267, II, 2° of the French General Tax Code. The proof of payment issued by the Official Portal is available in your Tracking Area.

7.3 Currency conversion

Where the Government Fee is denominated in a currency other than the one you have chosen, it is converted at the exchange rate displayed in the summary before payment. This rate is the reference rate obtained by Visaska from its exchange-rate data provider at the time of display; no exchange margin is applied. Exchange-rate fluctuations between your payment and the actual payment to the Authority are borne by Visaska: no additional payment is requested from you and no difference is charged to you on that account.

Any charges levied by your bank for a payment in a foreign currency are not the responsibility of Visaska.

7.4 Service Fees

Service Fees are the remuneration of Visaska. They are subject to VAT at the applicable rate, which is included in the displayed price.

7.5 Change in Government Fees by the Authority

If the Authority changes the amount of its fees between your payment and the Submission:

  • in the event of a decrease, the difference is refunded to you;
  • in the event of an increase, Visaska informs you before any Submission and offers you, at your choice, to pay the difference or to cancel the order with a full refund of the Service Fee and the Government Fee. The time elapsed between this notification and your response constitutes a Delay Attributable to the Customer within the meaning of Article 9.4.

8. Payment

Payment is due upon ordering. It is made online through our payment service provider Stripe, by bank card (in particular Visa, Mastercard, American Express, depending on the methods displayed), Apple Pay or Google Pay. The amount is debited in the currency displayed at the time of the order.

Payments are secured by the TLS protocol and, where applicable, by strong cardholder authentication (3-D Secure). Visaska does not have access to your full bank card details and does not store them.

If payment is refused, the order is not concluded. In the event of an improper payment dispute with your bank where the Service has been performed, Visaska reserves the right to pursue recovery of the sums due.

An invoice is made available to you in your Tracking Area and sent to you by email.

9. Performance of the Service and Promised Delivery Date

9.1 Your obligations

Performance of the Service requires your cooperation. You undertake to:

  • provide information that is accurate, complete and up to date, and identical to that shown on the Traveller's passport;
  • complete the Questionnaire and provide compliant documents as soon as possible;
  • respond without delay to any request for information or documents from Visaska or the Authority;
  • check your email and your Tracking Area regularly;
  • report any change immediately (passport, travel dates, contact details).

You are solely responsible for the accuracy of the information provided. Visaska enters the information as you have provided it; where data is extracted automatically from your documents (character recognition), it is presented to you for verification and you validate it before Submission.

9.2 Our commitments

Visaska undertakes to:

  • check the documents provided and notify you of any apparent non-compliance;
  • make the Submission within the Submission Deadline of the chosen Plan from the moment the Questionnaire is completed;
  • track the Application and inform you of any request from the Authority;
  • make the Delivery no later than the Promised Delivery Date, subject to the Exclusions.

9.3 Calculation of the Promised Delivery Date

The Promised Delivery Date is calculated for each destination and each Plan by adding together: the processing time announced by the Authority, the Submission Deadline of the Plan and a safety margin. It is displayed before payment, repeated in the order confirmation and visible in your Tracking Area.

The countdown to the Promised Delivery Date starts at the time of payment. It is set on the assumption that the Questionnaire is completed at the time of payment or immediately afterwards; it is postponed under the conditions of Article 9.5.

9.4 Exclusions

The following events constitute Exclusions:

  1. Delay Attributable to the Customer: any period during which the Submission or the continuation of the Application depends on action by the Customer, namely:
    • the period between payment and the moment the Questionnaire is completed;
    • the period between the sending by Visaska of a request for information, correction or a document and the receipt of a complete and compliant response;
    • the time needed to correct or resubmit an Application because of inaccurate, incomplete or inconsistent information provided by the Customer, or of a non-compliant, illegible or falsified document;
    • any period during which the Customer cannot be reached using the contact details he or she has provided;
    • any change requested by the Customer after payment (travel dates, passport, Plan, Traveller);
    • the period during which a payment is pending, rejected or disputed.
  2. Force majeure: any event meeting the definition in Article 1218 of the French Civil Code, that is to say, beyond the control of Visaska, which could not reasonably have been foreseen when the contract was concluded and whose effects cannot be avoided by appropriate measures, such as: natural disaster, war, terrorist attack, riot, epidemic and health measures, government decision to suspend visas or close borders, widespread failure of telecommunications or electricity networks.
  3. Unavailability of the Official Portal: any period during which the Official Portal is inaccessible, under maintenance, malfunctioning to the point of preventing Submission or payment, or refusing payment methods, or during which the Authority suspends the electronic visa programme concerned. Visaska keeps evidence of the unavailability (timestamped screenshots, error messages, announcements by the Authority) and provides it to you on request.
  4. Additional request from the Authority: any decision by the Authority, after Submission, to request additional information or documents, to summon the Traveller for an interview or biometric data collection, or to subject the Application to in-depth examination, the Exclusion period running from the notification of that decision until the Authority's new decision.

9.5 Effect of the Exclusions

The Promised Delivery Date is postponed by a period equal to that of the Exclusion. Where the Exclusion results in a later Submission, the Promised Delivery Date is recalculated from the actual Submission using the method in Article 9.3, to the extent necessary to take account of the Exclusion. Visaska informs you of the new date in your Tracking Area and by email.

9.6 Delivery

The visa or authorisation issued by the Authority is sent to you by email and remains available in your Tracking Area for the period indicated in the Privacy Policy. We recommend that you save it and, where the destination so requires, print it.

You must check, upon receipt, the accuracy of the information shown on the document (name, passport number, dates, type of visa) and notify us of any error without delay. If the error results from data entered by Visaska that differs from the information you provided, Visaska shall, at its own expense, carry out the correction procedures or make a new Application, including payment of a new Government Fee if necessary.

10. Timeframe guarantee

If Delivery takes place after the Promised Delivery Date, other than as a result of an Exclusion:

  • the Service Fee for the Application concerned is refunded to you in full;
  • for the Super Rush Plan, the Government Fee is also refunded to you by Visaska, which bears its cost, as the Authorities do not refund such fees.

The guarantee applies to the transmission of the Authority's decision, whether favourable or unfavourable. In the event of a refusal decision transmitted after the Promised Delivery Date, you choose between the refund provided for in this Article and the new application provided for in Article 11; these two benefits cannot be combined.

The refund is made automatically, without your having to request it, under the conditions of Article 12.4.

11. Refusal of the Application by the Authority

The Authority alone decides on the outcome of the Application. A refusal does not give rise to any right to a refund of the Service Fee, since the Service has been performed, or of the Government Fee, which the Authorities do not refund.

In the event of a refusal, Visaska offers you a new application with no Service Fee, on the following conditions:

  • the new application concerns the same Traveller, the same destination and the same trip (dates may be adjusted);
  • it is ordered within 90 days of notification of the refusal;
  • it is made under the same Plan or a lower Plan; choosing a higher Plan gives rise to payment of the difference in Service Fees only;
  • the Government Fee for the new application remains payable;
  • the offer is limited to one new application per refused Application.

This offer does not apply where the refusal results from false information or falsified documents knowingly provided by the Customer or the Traveller.

Where the refusal results from an error by Visaska (data entered differently from the information provided, wrong document uploaded), Visaska refunds the Service Fee and the Government Fee and also offers you a new application with no Service Fee.

Where the Authority declares the Application inadmissible or refuses to examine it after Submission, the situation is treated as a refusal within the meaning of this Article, unless the inadmissibility results from an error by Visaska.

12. Cancellation and refunds

12.1 Cancellation before Submission

You may cancel your order at any time before Submission, from your Tracking Area or by email to contact@visaska.com. In that case:

  • the Service Fee is refunded to you in full;
  • the Government Fee is refunded to you if it has not yet been paid to the Authority. If it has already been paid (some Official Portals require payment before submission), it is refunded only if the Authority refunds it, in which case the sum received is passed on to you in full.

12.2 Cancellation after Submission

After Submission, the Service has been fully performed. Neither the Service Fee nor the Government Fee is refunded, subject to the timeframe guarantee (Article 10), the case of an error by Visaska (Articles 9.6 and 11) and the cases provided for in Article 12.3.

12.3 Other refund cases

  • Double payment: any payment made twice for the same Application is refunded in full.
  • Impossibility of Submission: if Submission proves impossible for a reason not attributable to the Customer (permanent closure of the Official Portal, abolition of the electronic visa programme, Traveller having become ineligible as a result of a change in the rules), the Service Fee is refunded in full and the Government Fee is refunded under the conditions of Article 12.1.
  • Decrease in the Government Fee: see Article 7.5.

12.4 Refund arrangements

Refunds are made to the payment method used for the order, in the payment currency, within 14 days of the refund decision or, in the event of withdrawal, of the day on which Visaska is informed of your decision to withdraw. Depending on your bank, an additional period of 5 to 10 working days may be needed before the amount appears in your account.

The refund cases are summarised in the Refund Policy, which does not derogate from these GTCS.

13. Right of withdrawal

13.1 Principle

In accordance with Articles L221-18 et seq. of the French Consumer Code, as a consumer you have a period of 14 days from the conclusion of the contract in which to exercise your right of withdrawal, without having to give reasons for your decision or bear any costs other than those provided for in Article 13.4.

13.2 Exercise

To exercise this right, you must notify us of your decision to withdraw by means of an unambiguous statement:

  • from your Tracking Area ("Cancel my application" button);
  • by email to contact@visaska.com;
  • or by post to Kondoria — EURL, 60 rue François Ier, 75008 Paris, France.

You may use the model withdrawal form set out in the annex, but this is not mandatory. We send you an acknowledgement of receipt on a durable medium without delay. To meet the withdrawal deadline, it is sufficient for you to send your communication before the withdrawal period has expired.

13.3 Immediate performance and loss of the right of withdrawal

As visa issuing times are often constrained by the travel date, the Service can begin before the end of the withdrawal period only at your express request. When ordering, a checkbox, which is not pre-ticked, allows you to declare:

"I request that performance of the service begin immediately, before the end of the 14-day withdrawal period. I acknowledge that I will lose my right of withdrawal as soon as my application has been submitted to the authorities, the service then being fully performed."

Without this request, performance of the Service begins only on expiry of the withdrawal period, and the Promised Delivery Date is recalculated accordingly.

In accordance with Article L221-28, 1° of the French Consumer Code, the right of withdrawal can no longer be exercised once the Service has been fully performed, that is to say once Submission has taken place, where performance began after your prior express consent and your acknowledgement that you would lose your right of withdrawal.

Where an order covers several Travellers, full performance is assessed Application by Application: the right of withdrawal remains available for Applications that have not yet been submitted.

13.4 Withdrawal after performance has begun

In accordance with Article L221-25 of the French Consumer Code, if you exercise your right of withdrawal after having requested immediate performance of the Service, but before its full performance, you are liable to pay an amount proportionate to the Service provided up to the time you communicated your decision to withdraw, in relation to the total price of the Service.

However, Visaska waives this amount: in the event of withdrawal before Submission, the Service Fee is refunded to you in full. The Government Fee is refunded under the conditions of Article 12.1; if it has already been paid to the Authority on your instructions, it corresponds to an expense incurred in performance of the mandate and is refunded only if the Authority refunds it.

13.5 Refund

In the event of withdrawal, Visaska refunds the sums due to you no later than 14 days after the date on which it is informed of your decision, using the same means of payment as that used for the initial transaction, unless you have expressly agreed to another means. This refund does not incur any charge for you.

14. Liability

14.1 Nature of the obligations of Visaska

Visaska is bound by:

  • an obligation to achieve a specific result (obligation de résultat) as regards the Submission of the Application within the Submission Deadline of the chosen Plan, from the moment the Questionnaire is completed, excluding Exclusions;
  • an obligation to use its best endeavours (obligation de moyens) as regards the outcome of the Application: Visaska applies its expertise to present a complete and compliant Application, but cannot guarantee that the Authority will accept it or the time within which it will reach its decision.

14.2 Limits

Visaska is not liable for:

  • the decisions of the Authority, in particular a refusal, a request for additional information, a processing time or a period of validity different from that applied for;
  • a refusal of boarding by a carrier or a refusal of entry into the territory decided by the border control authorities, whose decisions are sovereign, including where the Traveller holds a valid visa or authorisation;
  • the consequences of inaccurate, incomplete or outdated information, or of non-compliant or falsified documents, provided by the Customer or the Traveller;
  • the Traveller's failure to comply with the other conditions of entry and stay (passport validity, vaccinations, means of subsistence, insurance, authorised length of stay);
  • delays or impossibilities resulting from an Exclusion;
  • the content and operation of the Official Portals and third-party websites.

14.3 Consumer Customers

No provision of these GTCS is intended to or has the effect of limiting or excluding the liability of Visaska in the event of gross negligence or wilful misconduct (faute lourde ou dolosive) or personal injury, or of depriving consumers of their right to compensation in the event of a breach by Visaska of any of its obligations.

14.4 Business Customers

With regard to business Customers, the liability of Visaska is limited to direct and foreseeable damage and, for all causes combined, to the amount of the Service Fee paid for the Application concerned, except in the event of gross negligence or wilful misconduct.

15. Force majeure

Neither party is liable for a failure to perform its obligations resulting from an event of force majeure within the meaning of Article 1218 of the French Civil Code. If the impediment is temporary, performance is suspended and the Promised Delivery Date is postponed in accordance with Article 9.5. If the impediment is permanent or continues for so long that the Service becomes of no use to you (for example, because the travel date has passed), the contract is terminated (résolu) and the sums paid are refunded to you under the conditions of Article 12.1 if Submission has not taken place.

16. Customer service and complaints

16.1 Contact

Customer service can be reached:

  • via the messaging service in your Tracking Area;
  • by email at contact@visaska.com;
  • by post at Kondoria — EURL, 60 rue François Ier, 75008 Paris, France.

We reply to messages within 24 working hours as a general rule, and within a shorter time for the Rush and Super Rush Plans while the Application is being processed.

16.2 Complaints

Any complaint must be made in writing (Tracking Area, email or post), stating the order number, the Traveller concerned and the precise subject of the complaint, accompanied where applicable by the relevant documents. We acknowledge receipt within 2 working days and send you a reasoned response within a maximum of 30 days.

We invite you to contact us before disputing a payment with your bank: most situations are resolved more quickly in this way.

17. Consumer mediation

In accordance with Articles L612-1 et seq. of the French Consumer Code, if your written complaint has not led to a satisfactory solution, or if you have received no response within two months, you may have recourse, free of charge, to the consumer mediator to which Kondoria — EURL is subject:

  • Centre de médiation de la consommation de conciliateurs de justice (CM2C)
  • 14 rue Saint Jean, 75017 Paris, France
  • https://www.cm2c.net

The matter must be referred to the mediator within one year of your written complaint to Visaska. A request for mediation may be declared inadmissible in particular if you have not first attempted to resolve the dispute directly with us, if it is manifestly unfounded or abusive, or if the dispute has already been examined by another mediator or by a court. The parties remain free to accept or reject the solution proposed by the mediator.

18. Personal data

Visaska processes your personal data and that of the Travellers in order to perform the Service, in accordance with Regulation (EU) 2016/679 (GDPR) and French Law No. 78-17 of 6 January 1978 on information technology, data files and civil liberties. Performance of the Service involves the transmission of the Travellers' data to the Authority of the destination country, which may be located outside the European Union. The purposes, legal bases, recipients, retention periods and your rights are described in the Privacy Policy.

19. Evidence and archiving

Computerised records kept in the systems of Visaska and its service providers under reasonable security conditions (timestamps of orders, acceptances and requests for immediate performance, processing logs, Official Portal receipts) are deemed to constitute evidence of the communications, orders and payments made between the parties, unless proven otherwise.

In accordance with Articles L213-1 and D213-1 of the French Consumer Code, where the amount of the order reaches the regulatory threshold, Visaska keeps the written record of the contract for the statutory period and guarantees you access to it upon simple request to contact@visaska.com. Accounting records are kept for 10 years in accordance with Article L123-22 of the French Commercial Code.

20. Amendments to the GTCS

Visaska may amend these GTCS at any time. The GTCS applicable to your order are those accepted at the time of the order; subsequent amendments are not enforceable against you in respect of that order.

21. Language

These GTCS are drafted and published in English only. No translation is provided.

22. Governing law and jurisdiction

These GTCS are governed by French law. If you are a consumer habitually resident in another country, this choice does not deprive you of the protection afforded to you by the mandatory provisions of the law of your country of habitual residence, in accordance with Article 6 of Regulation (EC) No 593/2008 (Rome I).

In the event of a dispute, and after an attempt at amicable resolution or mediation, consumers may bring proceedings, at their choice, before one of the courts having territorial jurisdiction under the French Code of Civil Procedure or before the court of the place where they resided at the time the contract was concluded or the harmful event occurred, in accordance with Article R631-3 of the French Consumer Code. Consumers domiciled in another Member State of the European Union may also bring proceedings before the courts of their domicile, in accordance with Regulation (EU) No 1215/2012.

For business Customers, any dispute falls within the exclusive jurisdiction of the courts within the territorial jurisdiction of the Paris Court of Appeal, including in the event of multiple defendants or third-party claims.

23. Miscellaneous provisions

If any provision of these GTCS is declared null and void or unenforceable, the other provisions shall remain in full force and effect. The fact that Visaska does not rely on a breach shall not constitute a waiver of its right to rely on it subsequently.

Visaska may use service providers to perform certain tasks; it remains responsible to you for the proper performance of the Service.
